Aircraft accident and incident investigation

Annex 13 contains the ICAO SARP’s for the investigation of accidents and incidents The objective is to prevent accidents and incidents not to blame someone

An accident = an occurrence associated with the operation of an aircraft which takes place between the time any person boards the aircraft with intention of flight until such time as all such persons have disembarked, in which;

- A person is fatally or seriously injured, or
- The aircraft sustains damage or structural failure, or
- The aircraft is missing or completely inaccessible

An incident = an occurrence other than an accident, associated with the operation of an aircraft which affects or could affect the safety of operation.



A serious incident = an incident involving circumstances indicating that an accident nearly occurred.

State of design = The state having jurisdiction over the organization responsible for the type design.

State of manufacture = The state having jurisdiction over the organization responsible for the final assembly of the aircraft.

State of occurrence = The state in the territory of which an accident or incident occurs. He will be responsible for initiation of an accident investigation. However, this may be delegated, in whole or in part, to the state of registry and state of operator.

ICAO is to be notified of any accident or serious incident involving an aircraft with a maximum mass of > 2250kg. A final report must be sent to ICAO for an aircraft with a maximum mass of > 5700kg

When the max mass is over 100.000 kg, the state of design and the state of manufacture shall in the case of an accident or serious incident inform the state of occurrence of the name of its representative to be present at the investigation.
